Legal Entity Notice

The legal business name is FlatMusic Inc. In Korean, it is 플랫뮤직 주식회사. Both refer to the same legal entity.

Article 1 (Purpose)

These Terms of Service (the “Terms”) define the rights, obligations, and responsibilities between the Company and Users regarding access to and use of the Arpe service (the “Service”).

Article 2 (Definitions)

  • “Service” means the Arpe application and related services provided by the Company, including music practice support, audio recording, file upload, music score conversion (including MusicXML), practice feedback, annotation, and score sharing features.
  • “User” means any individual who creates an account or uses the Service.
  • “Content” means all data uploaded, recorded, generated, or shared by the User through the Service, including audio recordings, images, uploaded files, converted music scores, annotations, feedback, comments, practice records, and metadata.
  • “Shared Content” means Content that a User chooses to share with other Users or reviewers through the Service.

Article 3 (Account Registration and Responsibility)

  • Users may be required to create an account to access certain features of the Service.
  • Users must provide accurate and up-to-date information and are responsible for maintaining the confidentiality of their account credentials.
  • Users are responsible for all activities conducted under their account.
  • A User under the age of 14 may create an account and use the Service only with the consent of their parent or legal guardian where required by applicable law. The Company may require reasonable verification of that consent before providing the Service.

Article 4 (Service Description and Nature)

  • The Service provides automated, software-based features for music practice and learning.
  • The Service allows Users to record audio via microphone, upload audio or image files, and convert such Content into digital music scores.
  • The Service may provide automated analysis and feedback.
  • When Users choose to share Content for feedback, human reviewers may provide comments, annotations, or written feedback through the Service.

Article 5 (User Content and Copyright)

  • Users retain ownership of the Content they upload or generate.
  • Users represent and warrant that they have all necessary rights, licenses, or permissions to upload, record, convert, and share Content through the Service.
  • The Company does not claim ownership of User Content and processes Content solely for the purpose of providing the Service.
  • Users are solely responsible for any copyright infringement, licensing disputes, or legal claims arising from their Content.

Article 6 (Score Sharing and Re-sharing Restrictions)

  • The Service allows Users to share music scores and related Content with others.
  • Shared Content may be viewed and used only within the scope permitted by the Service.
  • Re-sharing, redistribution, copying, or further publication of Shared Content is prohibited in order to prevent copyright infringement and protect the rights of content owners.
  • Users must not attempt to bypass or circumvent sharing restrictions implemented by the Service.

Article 7 (Prohibited Conduct)

Users must not:

  • Upload or share Content that infringes third-party rights or violates applicable law
  • Upload Content without proper copyright or usage rights
  • Re-share or redistribute Shared Content without authorization
  • Attempt unauthorized access, reverse engineering, or security testing
  • Distribute malware or abuse the Service
  • Use the Service for unlawful or harmful purposes

The Company maintains a zero-tolerance policy toward objectionable or abusive content and behavior.

The Service provides mechanisms that allow Users to report or flag objectionable or abusive Content and to block other Users who engage in such behavior.

Upon receiving a report, the Company will review the reported Content and take appropriate action, including removal of the Content and suspension or termination of the offending User’s account, within 24 hours.

Article 8 (Disclaimer)

  • Automated outputs and human feedback provided through the Service are for reference and educational purposes only.
  • The Company does not guarantee accuracy, completeness, or fitness for any particular purpose.
  • Users are responsible for reviewing and verifying all outputs before use.

Article 9 (Service Availability and Changes)

  • The Company may modify, suspend, or discontinue any part of the Service for technical or operational reasons.
  • Temporary interruptions may occur due to maintenance, updates, or external factors.

Article 10 (Termination)

  • Users may terminate their account at any time through available Service features.
  • The Company may suspend or terminate access for violations of these Terms or applicable law.
  • Upon termination, access to stored Content may be limited or removed in accordance with applicable law.

Article 11 (Limitation of Liability)

  • To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.
  • The Service is provided on an “as is” and “as available” basis.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by the laws of the Republic of Korea. Disputes shall be subject to the jurisdiction of competent courts of Korea.

Article 13 (Effective Date and Updates)

These Terms are effective as of the date posted.
